1. Introduction

Welcome to ZimboVerse. These Terms of Use ("Terms") govern your access to and use of our website, mobile application, and services (collectively, the "Platform"). By accessing or using ZimboVerse, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. By using ZimboVerse, you confirm that you meet these requirements.

Businesses and individual entrepreneurs who list their services or products must ensure that they have the authority to represent their business and that the information provided is accurate.

3. Your Use of Our Services

You agree to use the Platform only for lawful purposes and in accordance with these Terms.

You are responsible for safeguarding your account credentials. Notify us immediately if you suspect unauthorised access.

4. Business Listings and Content

When you create a business listing, you may provide the following information:

• Business name, category, and description
• Contact information (phone number, email, website)
• Physical address and location coordinates
• Business photos

Public Visibility: All business listings are publicly visible to users of the Platform. This includes your business name, description, contact information, address, photos, and location on the map. By creating a listing, you consent to this information being displayed publicly.

Your Responsibilities: You are responsible for the accuracy and legality of all information in your listings. All descriptions, images, prices, and offers must be accurate, lawful, and up to date. You must have the authority to represent the business you are listing.

Content Licence: By posting content, you grant ZimboVerse a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, and distribute such content for the operation of the Platform.

Review Process: All business listings are subject to review by our team before appearing in the directory. We typically review submissions within 1-3 business days. We reserve the right to reject or remove any listing that violates our policies.

You must not post content that infringes on the rights of others, violates applicable laws, or contains false or misleading information.

5. Services Provided

ZimboVerse provides the following services:

• Radio Streaming: Stream Zimbabwean radio stations with optional recording functionality
• Airtime Top-Up: Send airtime to Zimbabwean mobile networks (Econet, NetOne, Telecel)
• Bill Payments: Pay ZESA, TelOne, water bills and other utilities
• Business Directory: Search, discover, and list businesses with location-based services
• Games: Play Zimbabwean-themed games including Shona Wordle, puzzles, and word searches
• User Profiles: Create and manage your personal profile
• Other services as may be added from time to time

6. Payments and Billing

For services that require payment:

• All prices are subject to change without notice
• Payment must be received in full before services are rendered
• We accept various payment methods as displayed in the application
• All transactions are processed securely through our payment partners
• Refunds are subject to our refund policy

7. Radio Streaming Services

ZimboVerse provides access to publicly available radio station streams. We do not claim ownership or licensing rights to these radio streams. The radio streaming feature is provided as a convenience to our users to access publicly broadcast content.

If you are a radio station owner or representative and do not want your stream URL included in our application, we respect your rights and will promptly remove it upon request. Please contact us using the contact information provided in Section 16 below, and we will remove your stream within 48 hours of receiving your request.

We encourage radio stations to reach out if they have any concerns or would like to discuss partnership opportunities.

8. User Accounts and Profiles

To use ZimboVerse, you must create an account by providing:

• First name and last name
• Email address for authentication
• Date of birth (optional)
• Gender (optional)

Your personal profile information (name, date of birth, gender) is kept private and is not displayed publicly. Only business listings you create will be visible to other users.

User Responsibilities: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

Interactions with Businesses: Users may interact with businesses via the Platform (phone, WhatsApp, email) but are solely responsible for decisions made based on listings or communications. ZimboVerse does not verify the authenticity of each listing, although we reserve the right to remove any content that violates our policies.

9. Intellectual Property Rights

All content and materials on the Platform, including logos, text, graphics, and software, are owned by or licensed to ZimboVerse and are protected by intellectual property laws.

You are granted a limited, non-transferable licence to access and use the Platform for its intended purposes. You may not copy, reproduce, or exploit any part of the Platform without our written consent.

10. Termination and Suspension

We may suspend or terminate your account if you breach these Terms or if your use of the Platform poses a risk to us or other users.

Upon termination, your access to the Platform will be revoked, but any obligations or liabilities incurred prior to termination shall survive. If you wish to terminate your account, you may simply discontinue using the Service.

11. Disclaimers and Limitations of Liability

ZimboVerse provides the Platform "as is" and does not guarantee the accuracy, availability, or completeness of listings or content.

To the fullest extent permitted by law, we disclaim all warranties and will not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Platform.

12. Indemnity

You agree to indemnify and hold harmless ZimboVerse, its officers, directors, employees, and affiliates from any claims, liabilities, or expenses arising from:

• Your use of the Platform
• Your content
• Your breach of these Terms
• Your violation of any rights of another party

13. Privacy and Cookie Policies

Our collection and processing of your personal information are governed by our Privacy Policy.

14. Modifications to Terms

We may amend these Terms from time to time. If we make significant changes, we will notify users by email or through a notice on the Platform.

Your continued use of the Platform constitutes acceptance of the revised Terms. We will provide at least 30 days notice prior to any new terms taking effect.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
